This website and your use thereof are governed by the Terms of Use as defined below, and the Additional Terms set forth in this document (“Additional Terms“).
“Terms of Use” means Online Services Terms of Use and Privacy Policy of the Medical Center available at https://www.szmc.org.il/en/about/disclaimer-terms-of-use/. The Terms of Service apply to the website, which operates within the framework of the Medical Center’s online services.
Any use or attempt to use the Website constitutes the user’s (“User“) approval of these Additional Terms, the Terms of Use and agreement that they shall apply to them. If you do not agree, you must cease your use of the Website.
- Online Services. “Tasty and Healthy” is a whole-food diet, which aims to help reduce intestinal inflammation for those suffering from Inflammatory bowel disease (the “Diet”). The Website presents research that led to the development of the Diet, the principles of the Diet, and it allows users to receive various types of information about the Diet, such as suggested recipes. The Website also offers features that allows participance of the Users and sharing User content, such as the ‘Ask an Expert’ feature where users can submit questions and receive answers. Users can also subscribe to our newsletter to receive updates on new research, recipes, and tips related to the Diet.
- No medical or nutritional advice.
- The Online Services, including any User Information and content provided through the Website, are not intended to serve as a substitute for medical diagnosis, opinion, advice, recommendation for treatment or substitute for treatment, or nutritional advice, and do not constitute a substitute for approaching any of the Medical Center staff or other physicians of dietitians, for obtaining medical history, consultation, guidance or treatment as may be needed. These statements apply to all users in general and are specifically relevant to any User suffering from a medical condition requiring special nutrition, such as Crohn’s and Colitis diseases.
- The Diet and additional diets which may be available on the Website, are diets that we believe may help Users ease their condition. However, the Medical Center cannot assure that any diet will actually work and ease any condition. The suggested diets are not a substitute for receiving individual medical and nutritional advice that corresponds to each User’s specific medical condition.
- We recommend that Users use the information offered on the Website with the necessary caution and in consultation with the healthcare professionals treating them. The Medical Center shall not be liable for any damage that may result from reliance on the information provided on the Website without proper medical and nutritional consultation.
- The Medical Center may update, modify, or change the content, information, recommendations, and research findings presented on the Website regarding the Diet at any time without prior notice. It is the User’s responsibility to regularly check the Website for the most current information. The Medical Center does not undertake to notify Users individually of any changes made to the Website content.
- User Content and Third-Party Content
- Some of the content made available on the Website may be created by Users. For example, each User may post questions or comments, this content is Third Party Content. The Website also refers you to amazon, tranzilla or similar payment / procurement services. These are third party service providers and the content in these referrals is Third Party Content as well.
- The Medical Center has no control over and assumes no responsibility for the Third-Party Content (or associated content, policies, or practices). The Medical Center does not monitor Third Party Content and its availability through the Website does not constitute any endorsement or recommendation on our behalf.
- By accessing Third Party Content, The User agrees to use Third Party Content (a) in person and for non-commercial purposes; and (b) in accordance with the restrictions set out in the applicable laws, additional terms, guidelines and policies or on the product pages that apply to that particular piece of Third-Party Content. The User acknowledges that any access to third-party websites or use of their services is subject to the terms of use and privacy policies of those websites, and the User undertakes to review them and act in accordance with them. - Acceptable Posting of Third-Party Content. Each User undertakes not to post any content that:
- Violates, misappropriates, or infringes the rights of others, including privacy, publicity, intellectual property, or other proprietary rights.
- Is illegal, obscene, defamatory, threatening, intimidating, harassing, hateful, racially or ethnically offensive, or instigates or encourages conduct that would be illegal or otherwise inappropriate, such as promoting violent crimes, endangering or exploiting children or others, or coordinating harm.
- Involve publishing falsehoods, misrepresentations, or misleading statements.
- Impersonate someone.
- Involve sending illegal or impermissible communications such as bulk messaging, auto-messaging, auto-dialing, and the like; or
- Involve any non-personal use of the Website unless otherwise authorized by us.
- The Medical Center does not undertake to publish any User Content submitted to it and reserves the right to remove User Content at any time, at its sole discretion and without prior notice.
- Intellectual Property Rights in User Content
- By submitting, posting, uploading, or otherwise making available any User Content through the Website, the User hereby grants to the Medical Center a worldwide, non-exclusive, royalty-free, fully paid, perpetual, irrevocable, transferable, and fully sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content (in whole or in part) on the Website and on any other platforms or media, and to incorporate it in other works in any format or medium now known or later developed, for any purpose, commercial or otherwise, without compensation to the User.
- The User represents and warrants that: (i) they own the User Content posted by them on or through the Website or otherwise have the right to grant the license set forth in this section, and (ii) the posting of their User Content on or through the Website does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity.
- The Medical Center reserves the right to edit, modify, or reformat User Content prior to publication, while maintaining the essential meaning of the content. The Medical Center may also use User Content for research, educational, or promotional purposes, including but not limited to publications, presentations, and online distribution.
- The User acknowledges that once they submit User Content to the Website, such content may not be retractable, and the Medical Center is under no obligation to remove or delete such content upon the User’s request, although the Medical Center may, at its sole discretion, honor such requests.
- Privacy
- Any data or information provided by the User shall be treated in accordance with the Terms of Use.
- When a User provides us with certain User Content, we may post such content or otherwise make it available to others with additional content of our own. For example, when a User submits a question in the “Ask an Expert” section, we may publish the question along with the User details provided, and alongside it publishes a response (from our team) to this question.
- User Content and Users Information made available on the Website may be shared with other Users.
- Newsletter Subscription.
- Users may subscribe to our newsletter to receive updates on new research, recipes, tips related to the Diet, or new publications on the Website. By subscribing to the newsletter, the User consents to receive periodic emails from the Medical Center.
- The User may unsubscribe from the newsletter at any time by clicking the ‘unsubscribe’ link at the bottom of any newsletter email or by contacting the “Tasty and Healthy” team using contact details below
- Book purchase
- The Website contains a link to purchase “Tasty and Healthy”TM If you are from Israel, you may purchase the book directly from the Medical Center facilitating payments through Tranzilla and if you are located outside Israel purchase shall be made through Amazon. The purchase is subject to Amazon and Tranzilla terms and each User should review the prior to making a purchase.
- In addition, the purchase of the book is subject to the Terms of Use and Additional Terms.
- Removal of Content
- If you find infringing content on the Website, you may request the Medical Center to remove the infringing material. In such request you should provide –
- A physical or electronic signature of the copyright owner of the right so infringed.
- Identification of the specific item / right infringed.
- Identification of the material that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material (e.g. URL).
- Information reasonably sufficient to permit the service provider to contact the complaining party, such as address, telephone number, and e-mail address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized.
